REBATE OFFER TERMS AND CONDITIONS

  1. SPONSOR/OFFEROR. A&E Audiology, Inc., 2160 Noll Drive, Suite 100, Lancaster, PA 17603 is the “Sponsor” and “Offeror” of this Rebate Offer.

  2. REBATE OFFER. The rebate amount is equal to the value of one (1) monthly installment payment pursuant to the patient’s lease agreement with Allegro Credit® (the “Rebate Amount”). The Rebate Amount will be paid by the Sponsor to the patient, or in the case of a minor patient, to the Submitter, by check and mailed via First Class Mail to the address shown on the Rebate Offer Application. Rebate Amount will be issued by Sponsor on the later of: (1) sixty (60) days from the date of lease with Allegro Credit®, or (2) thirty (30) days from the date patient’s Rebate Offer Application form is completed and returned to Sponsor.

  3. ELIGIBLITY. Eligibility for this Rebate Offer is limited to patients of Sponsor with a mailing address in the Commonwealth of Pennsylvania. Offer not valid anywhere prohibited by law. This form may only be submitted by a person 18 years of age or older. If the patient is a minor, a parent or legal guardian may submit this form on behalf of a minor patient (the “Submitter”) so long as the Submitter agrees to be bound by the Rebate Offer terms and conditions and all requirements set forth herein are satisfied.

  4. PROMOTION PERIOD. The Rebate Offer is valid on the lease of any hearing aid(s) financed through Allegro Credit® from any of Sponsor’s locations from April 1, 2021 through June 30, 2021, and redeemed within 90 days of leasing agreement with Allegro Credit®. Rebate Offer is not available on any lease for which the patient returns the hearing aids.

  5. TERMS AND CONDITIONS. By participating in this Rebate Offer, you agree to comply with these Rebate Offer Terms and Conditions. Your right to receive the Rebate will not be earned unless you: (1) complete and timely submit the Rebate Offer Application, and (2) satisfy each of the conditions described in these Rebate Offer Terms and Conditions. Your failure to do so is a rejection of this Rebate Offer.

    Leasing of qualifying products is required for you to qualify for this Rebate Offer. No product substitutions, returns, or additions are allowed. This Rebate Offer is available to all patients of Sponsor with addresses in the Commonwealth of Pennsylvania, except where prohibited by law. Sponsor is not responsible for lost, late, damages, incomplete, illegible, misdirected, or postage-due submissions. All submitted materials become the property of Sponsor and will not be returned. You may wish to make a copy of your submitted materials for your records. Rebate Offer is limited to one (1) rebate per person. This Rebate Offer cannot be combined with any other offer by Sponsor. Rebate Offer subject to change.

  6. NOTICE TO CONSUMERS. The Rebate Amount will not exceed your total out-of-pocket costs. This rebate is only payable when you incur an out-of-pocket cost on your hearing aid(s). Sponsor reserves the right to change, modify, or discontinue this Rebate program at any time without notice and in its sole discretion. Sponsor further reserves its right to enforce reasonable fraud prevention measures at any time without notice.

  7. ARBITRATION AND WAIVER OF JURY TRIAL. All claims or disputes arising out of this Rebate and the Rebate Offer Terms and Conditions shall be decided by arbitration in accordance with the Rules of the American Arbitration Association unless the parties mutually agree otherwise. Notice of the demand for arbitration shall be filed in writing with the other party to this Agreement and with the American Arbitration Association and shall be made within six (6) months after the dispute has arisen. THE PARTIES HERETO HEREBY KNOWINGLY AND VOLUNTARILY WAIVE THEIR RIGHTS TO TRIAL BY JURY, AND ACKNOWLEDGE THAT THEY UNDERSTAND AND ACCEPT THE DISPUTE RESOLUTION PROCEDURE SET FORTH IN THIS AGREEMENT.

  8.  GOVERNING LAW. This Rebate and the Rebate Offer Terms and Conditions will be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania.
